Please read these Terms of Service carefully before using any of our services.

i. Introduction

These Terms of Service ("Terms") govern the provision of legal services by Brent Mainwood ("we," "us," "our," or "lawyer") to clients ("you" or "client"). By engaging our services, you agree to these Terms.

These Terms of Service provide a general overview of the terms under which Brent Mainwood provides legal services. They are not exhaustive and do not constitute a formal retainer agreement. For each specific legal matter, a detailed engagement letter or retainer agreement will be provided, which must be reviewed and signed before any formal attorney-client relationship is established or any legal work commences. The specific terms in your engagement letter or retainer agreement will govern the attorney-client relationship and may supplement or supersede portions of these general Terms of Service.

ii. Scope of Services

Brent Mainwood provides legal services primarily in the areas of real estate law in Alberta and British Columbia. The specific scope of services for each matter will be agreed upon in writing at the commencement of your engagement.

iii. Client-Lawyer (or Client-attorney) Relationship

A client-lawyer relationship is only formed after We have agreed to represent you and upon the execution of a formal engagement letter. Information shared on our website or during initial consultations does not create a client-lawyer relationship.

iv. Fees and Billing

Our fees can be based on hourly rates, flat fees, and contingency fees. The specific fee structure will be clearly outlined in your engagement letter.

In addition to our fees, you may be responsible for disbursements and other expenses incurred in handling your matter. We reserve the right to require a retainer before commencing work.

Invoices are due upon receipt. We reserve the right to withdraw from representation if invoices remain unpaid after 30 days.

v. Client Responsibilities

You agree to:

  • Provide accurate and complete information related to your legal matter.

  • Cooperate fully with us and promptly respond to our requests for information or documents.

  • Keep us informed of any changes in your contact information or circumstances relevant to your legal matter.

vi. Confidentiality and Privacy

We will maintain client confidentiality in accordance with the rules of professional conduct of the Law Society of Alberta and the Law Society of British Columbia. Please refer to our Privacy Policy for details on how we handle your personal information.

vii. Conflict of Interest

We will conduct a conflict check before accepting any new matter. If a conflict arises during our representation, we may be required to withdraw from your matter in accordance with our professional obligations.

viii. File Retention and Destruction

We will retain your files for a reasonable number of years after the conclusion of your matter, after which they may be destroyed without further notice, unless other arrangements are made.

ix. Termination of Services

The Website is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind.

  • You may terminate our services at any time by written notice.

  • We may withdraw from representation as permitted or required by the rules of professional conduct.

  • Upon termination, you agree to pay for all services rendered and expenses incurred up to the date of termination.

x. Limitation of Liability

Our liability is limited to the maximum amount of professional liability insurance coverage we maintain.

xi. Governing Law and Jurisdiction

These Terms are governed by the laws of Alberta, Canada. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Alberta.

xii. Changes to These Terms of Use

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
